O Juiz da Comarca de Itaju\u00edpe, Dr. Frederico Augusto de Oliveira determinou no \u00faltimo dia 24 de outubro que o prefeito Marcone Amaral (PSD), reitegre em at\u00e9 48 horas  dois servidores aposentados em Regime Geral da Previd\u00eancia Social (RGPS), aos seus respectivos cargos.<\/span><\/div>\n

Entenda o caso: no in\u00edcio do governo o  gestor havia afastado sem embasamento legal os servidores – com argumentos que os mesmos por estarem aposentados n\u00e3o deveriam est\u00e1 na ativa.  <\/span><\/div>\n

Na decis\u00e3o o juiz obriga ainda o gestor ressarcir  todos os sal\u00e1rios que deixou de pagar, desde quando foram afastados de suas fun\u00e7\u00f5es. Com esta decis\u00e3o – \u201climinar\u201d demais servidores que foram penalizados pelo gestor passam a ter jurisprud\u00eancia.<\/span>

Conforme contato telef\u00f4nico com este blog –  as advogadas Dra Jamile Aguiar e Dra Regina Gomes  solicitaram para  incluir seus respectivos  nomes na mat\u00e9ria acima que garantiu    mandado de seguran\u00e7a em face da Prefeitura Municipal de Itaju\u00edpe cometer um ato ilegal.<\/span><\/div>\n

<\/span>Segundo as defensoras o direito a reintegra\u00e7\u00e3o que foi concedido por meio \u00e9 uma garantia  – mandado de seguran\u00e7a inibe  os desmandos de um gestor que pratica atos manifestadamente ilegais.<\/span><\/div>\n
